By accessing or using this website, you are expressing your full and unreserved acceptance of these terms and conditions of use, as well as any indications, restrictions or rules that may be set in relation to specific sections or services on this website.
General Conditions
The present general contractual conditions, or other particular ones that may be established, regulate the relations between the company Pelicano Dourado, Lda, headquartered at Parque Industrial Sado Internacional Armazém E2 Estrada Nacional 10, Gâmbia-Pontes-Alto da Guerra, 2910 -130 Setúbal, Portugal, NIF 510137989, hereinafter referred to as WineSpiritus.com and the third parties that use the WineSpiritus.com website, hereinafter referred to as customers. “Product” means the goods object of the purchase contract.
This Privacy Policy regulates the possible collection and processing, namely consent, regarding personal data collected or provided by users anywhere on the winespiritus.com website, as well as the exercise of their rights in relation to this data, under the terms of the Regulation Data Protection Regulation (Regulation 2016/679 of the European Parliament and of the Council, of 27 April 2016).
Acceptance of Conditions
When using the services provided by WineSpiritus.com, the customer recognizes and accepts that all terms and conditions established in these general conditions will apply.
Customers
Alcoholic beverages may only be purchased by persons who, in their country of residence, are of legal age to do so.
Prices and availability
All prices shown are in € (Euros) and include VAT at the legal rate in force. The customer has the possibility to simulate the value of the product, selecting other available currencies. However, the purchase will always be made in € (Euros). The prices shown can be changed without prior notice and are always subject to stock outages. Orders will be executed on a first-come, first-served basis and, in the event of any temporary or even permanent outage of the product's stock, the customer will be duly notified and an alternative will be suggested with other products with similar characteristics.
Tax-free
The VAT amount can be deducted for public or private companies with legal registration. To do so, you must first send us the legally accepted tax number.
Contents
The description, image, and any other information of a product presented on WineSpiritus.com, can be changed without prior notice. The images illustrating each product may differ from the product delivered. We are not responsible for any typographical or arithmetical errors that may appear on our website.
Deliveries
Orders will be delivered by specialized companies for this purpose. As a rule, delivery to Mainland Portugal can occur within 24h to 72 hours, after dispatch from our facilities, for destinations in Europe and 5 to 7 days for the Rest of the World (see National and International Deliveries). There may be exceptions to which we are unrelated, such as natural disasters or other factors. The delivery period only starts after the shipment of the product from our facilities.
Absent Customer
It is the customer's responsibility to ensure that there will be someone to receive the order at the address indicated when making the purchase.
If the customer is absent, we may charge the amount for a new delivery.
Shipping Cost
Transport is optimized for boxes in modules of 1, 3, 6, 12 and 20 bottles depending on the number of bottles ordered. The amount to be charged for transport will be calculated automatically when making the purchase and varies according to the place of delivery and the weight of the goods in question.

Packing
As a delicate product, WineSpiritus.com has developed special reinforced cardboard packaging for the transport of bottles, developed with the aim of effectively protecting its contents. These packages are made up of an inner box that creates an air gap between the bottle and the outer cardboard box, minimizing possible impacts during the journey that could cause damage to the product. This packaging is environmentally friendly. More than a packaging, it can also serve as a modular wine cellar to form your wine cellar!
Payment
The customer will have at his disposal the following payment methods: Pay Pal (Visa, Mastercard, American Express, Discover...), Bank Transfer, Multibanco Reference, choosing one of them, according to his preference. All orders whose payment confirmation is not settled within a maximum period of 15 days will be cancelled. With regard to payment by credit card, if it is not confirmed, they will be canceled on the next business day. Payment by multibanco reference and payshop is only valid for Portugal.
Product Receipt
All products sent for purchases made at WineSpiritus.com must be examined immediately upon receipt. If any imperfection or damage to the product is detected, you must return it to the transport company, noting these circumstances in the carrier's document and clearly justifying the reason for the return in the delivery note that accompanies the product. Then you must immediately notify WineSpiritus.com of what happened, in order to resolve the occurrence as quickly as possible.
Order Cancellation
Orders can be canceled free of charge as long as it is done before the goods are shipped. After sending the goods, if a cancellation request is received, this will be treated as a return.
Returns
If you intend to return your purchase, you must immediately send an email to info@winespiritus.com. The reason for the return must be provided in the email. After sending, you will be informed on how to proceed with said return. You will have a period of 14 days after receiving the product to do so, and only goods that are received in the proper conditions (including the original packaging) will be accepted. Shipping costs will be borne by the customer. WineSpiritus.com will refund only the amount corresponding to the merchandise. Returns that derive from a product defect are excluded, and in this case WineSpiritus.com undertakes to exchange the product immediately for another one of the same or with identical characteristics.
Legal Impositions
WineSpiritus.com is not responsible for shipments made to countries where the respective law does not allow the entry of alcoholic beverages, being the responsibility of the customer to seize the respective order. In the event of returning the products, WineSpiritus.com will only refund the amount corresponding to the merchandise, minus financial charges and costs associated with the return of transport. Causes of Force Majeure
WineSpiritus.com is not responsible for contractual changes and for damages resulting from these changes, which may result from situations of force majeure, such as blocking telecommunications, natural catastrophes, blocking means of transport, strikes, as well as legislative changes or regulations, which make it entirely or partially impossible to provide the services provided for in these general conditions.
Cancellation of Orders
WineSpiritus.com reserves the right to cancel orders that originate incorrect amounts due to computer errors, immediately returning the amounts paid by customers. WineSpiritus.com is not responsible for damages that may arise from interference, omissions, interruptions, computer viruses, malfunctions or disconnections in its software, as well as in the customers' computer equipment, as well as for blockages and overloads in Internet browsing, or interferences in your data that are not your responsibility.
Blocked Access
WineSpiritus.com reserves the right to block the access of any users who use the WineSpiritus.com website in an abusive or irregular way or who, in any other way, constitute a current or potential threat to the normal functioning of the website to WineSpiritus.com or to third parties.
General Provisions
In the event that one or more provisions of these General Conditions of Contract are declared void, the rest of the provisions will continue to apply.
